1. Agreement to Terms

These Terms of Service constitute a legally binding agreement between you ("you") and PADEL GREEN ("we", "us", or "our"), concerning your access to and use of the PADEL GREEN platform. By accessing our services, you agree to be bound by these Terms.

2. Platform Ownership & Licensing

Proprietary Rights: The Padel Green Management Platform is a proprietary software solution owned and developed by Lumosoft (Pty) Ltd. Padel Green operates this platform under a non-exclusive, renewable license.

Intellectual Property: All source code, databases, functionality, software, website designs, backend architecture, and underlying technology are owned by Lumosoft and are protected by copyright and intellectual property laws. Content specific to Padel Green (logo, event details, community photos) remains the property of Padel Green.

User License: You are granted a limited license to access and use the Site for your personal, non-commercial use (e.g., booking events, managing membership) strictly in accordance with these Terms.

3. Membership & Accounts

You agree to provide accurate, current, and complete information during registration. You are responsible for safeguarding your password. We reserve the right to suspend or terminate accounts that violate our Code of Conduct.

4. Refund & Cancellation Policy

Events: Cancellations made less than 48 hours before an event are non-refundable. If we cancel an event (e.g., due to weather), a full credit or refund will be issued.

Rentals: Cancellations made less than 24 hours before a booking are non-refundable.

Membership Fees: Membership fees are non-refundable once the membership has been activated.

5. Equipment Rental Agreement

By renting equipment (bikes, rackets, etc.), you accept full responsibility for its care. You authorize us to charge you for any loss, theft, or damage occurring during your rental period. Late returns may incur additional fees.

6. Liability Waiver & Assumption of Risk

Voluntary Participation: You acknowledge that participating in outdoor activities (cycling, running, hiking) involves inherent risks, including physical injury or death.

Release: You hereby release and hold harmless Padel Green, its directors, employees, volunteers, and its technology partner (Lumosoft) from any liability for injuries or damages arising from your participation in club activities or use of this platform.

7. Governing Law

These Terms shall be governed by the laws of South Africa. Any disputes regarding the platform technology shall be subject to the terms of the Master Service Agreement between Padel Green and Lumosoft.
